Palm Beach County’s Clerk publishes a clear local distinction: its
Self Service Center offers petition forms and instructions, and after
the forms and fees are filed the judge reviews the matter at a hearing
scheduled by the court. The Clerk also warns that once a case is
expunged it cannot provide case information or copies, making pre-order
record preservation especially important.

The Palm Beach County process

  1. Search the case and obtain certified records. Use
    the Palm Beach Clerk’s official criminal court/eCaseView resources for
    docket research, then order a certified disposition for every count.
    Public search results alone are not enough for FDLE.
  2. Preserve the file before relief. Order any arrest,
    disposition, completion and court records the client may later need. The
    Clerk expressly says that after expungement it cannot provide
    information or copies and that certified copies should be requested and
    paid for beforehand.
  3. Complete the eligibility application. Expunction
    requires prosecutor certification; sealing does not. Both require the
    other FDLE materials and current eligibility analysis. The certificate
    does not guarantee the Palm Beach judge will approve the petition.
  4. Obtain the county court package. The Palm Beach
    Clerk’s Self Service Center offers forms and instructions for a nominal
    fee and provides a sealing/expungement workshop toolbox with educational
    material and disqualifying-charge information. Counsel may prepare the
    petition directly but should still confirm the current local
    procedure.
  5. File and pay the local charges. The Clerk’s general
    fee schedule lists $42 to seal or expunge a record, plus copy and
    certification charges. Fingerprinting and FDLE costs are separate.
  6. Check the assigned division’s current procedure.
    The Clerk’s general page says the judge reviews the documents at a
    hearing scheduled by the court. Current Fifteenth Circuit division
    instructions show why counsel must go further: Division E says an
    uncontested petition with the State’s written no-objection may proceed
    through an agreed proposed order, while a contested petition requires a
    hearing. Division D says seal/expunge hearings may be conducted by Zoom
    and separately describes a potential no-hearing route when the State
    agrees in writing to expungement. Those are division instructions, not a
    countywide promise or a statement that every sealing petition follows
    the same route.

Palm Beach’s preservation rule is a major client warning

People sometimes need the disposition or order later for a licensing,
immigration, military, education or disclosure issue. The right document
and disclosure answer depend on the context, but the Clerk’s warning is
straightforward: obtain needed certified copies before expungement
because the Clerk will not later produce case information through
ordinary channels.
