Leon County Record Sealing and Expungement Lawyer

Leon County’s record-clearing procedure is unusually specific. The Clerk publishes separate felony and misdemeanor or criminal-traffic packets, and the current criminal seal-or-expunge charge is $66.50. Choosing the right packet starts with the certified disposition and the complete Florida history.

Adam Dunn handles eligible Florida sealing and expungement matters from the firm’s Sarasota office. Dunn Law checks the certified Leon disposition, prior history, and current local packet before filing.

Find the Leon file and order the certified disposition

The Leon County Clerk’s court-record search can identify the criminal docket, but older images or some documents may not be available online. Certified documents can be ordered through the Clerk’s record-request and E-Certify routes. The current published fees are $1 per page plus $2 to certify a document.

Order the disposition for every count and collect any probation, diversion, or program-completion record. The court’s public summary is not a substitute for confirming the certified outcome.

Leon uses separate packets for different case types

The Clerk’s forms hub separates felony from misdemeanor and criminal-traffic matters, and it separates sealing from expunction. That is more than labeling: the petition, affidavit, proposed order, service certificate, and filing route need to match the actual Leon case.

  1. Check automatic sealing. A qualifying no-file or all-count nonconviction outcome may already fall under section 943.0595. Verify FDLE notice and actual public status before assuming a petition is required.
  2. For expunction, obtain the prosecutor certification. The Second Circuit State Attorney says the FDLE application must be delivered by mail or in person; electronic copies are not accepted. The office says processing can take a few weeks and returns the form by U.S. mail.
  3. Apply to FDLE. A sealing application skips the expunction-only Section B certification but still requires the rest of FDLE’s current packet. The Certificate of Eligibility is an eligibility determination, not the final relief.
  4. Send the State Attorney copies, then file and complete required service. Leon’s 2026 instructions call for sending copies of the petition materials and certificate to the State Attorney, then filing the petition, affidavit, proposed order, and original certificate with the Clerk. The packets and current statutes also require service on the arresting agency; the local certificate includes the sheriff if different and FDLE.
  5. Pay the correct Leon charge. The Clerk’s current fee page lists $66.50 for sealing or expunging a criminal record. Certified dispositions, copies, and other document costs are separate.

A victim objection can affect the Leon court process

The Clerk’s April 2026 instructions say Marsy’s Law may cause the State Attorney to contact a victim and allow 30 days for an objection. An objection can lead to a hearing that the petitioner must attend. This is Leon’s published local procedure, not a prediction that every case has a victim objection or hearing.

The same instructions warn that documents tied to a Clerk payment program remain public until the balance is fully paid and the Clerk is notified. That local processing issue should be identified early rather than after a petition is granted.

What automatic sealing leaves unanswered

When section 943.0595 applies, FDLE seals the qualifying history and the related court record becomes confidential after FDLE notice. Other criminal-justice agencies need not seal their own copies, and section 943.0595 does not itself govern private background databases. If a Leon case still appears, determine whether the court file, an agency copy, or a private report is the remaining source.

What Dunn Law can handle

Dunn Law can retrieve the Leon record, screen every count and the statewide history, prepare the FDLE application, coordinate the Second Circuit prosecutor certification for expunction, choose the correct local packet, complete service, file the petition and original certificate, and respond to any objection or hearing requirement.

Leon County questions

Can Section B be emailed to the Leon State Attorney?

The Second Circuit State Attorney’s current guide says to deliver the application by mail or in person and that electronic copies are not accepted.

Why is Leon’s court charge $66.50?

That is the amount on the Clerk’s current all-divisions fee schedule for sealing or expunging a criminal record. It is separate from FDLE, fingerprint, copy, and certification costs.

Does an objection mean the petition will be denied?

Not necessarily. It may lead to a hearing where the judge decides the petition. The facts, statutory criteria, objection, and assigned court procedure all matter.
