The end of an Escambia County prosecution does not necessarily end public access to the record. The first useful step is to identify every disposition and obtain a certified record. From there, the path may be automatic sealing, an FDLE certificate and court petition, or no available relief under the current statutes.

Escambia offers an electronic certified-record route
Many digitized court documents can be purchased through the Escambia County Clerk’s E-Certify service. When the needed disposition is not available there, the Public Records Center handles court-record requests. Its current schedule lists $1 per page, $2 to certify each document, actual postage, and a 3.5% credit-card surcharge.
Order the full disposition for every charge. A third-party background report may help identify a problem, but it cannot establish the certified outcome FDLE evaluates.
Ordering and filing the Escambia documents
- Check whether the record was automatically sealed. A qualifying no-file or all-count nonconviction outcome may trigger section 943.0595, subject to the statute’s exclusions. Verify the docket and actual public status rather than assuming every dismissal disappeared.
- Confirm the prosecutor route for an expunction. FDLE requires the appropriate prosecutor to complete its certified-statement page for an expunction application. As of September 19, 2026, no dedicated Escambia Section B workflow was located on the First Circuit State Attorney’s public site. Confirm the current intake route before mailing the form.
- Apply to FDLE. Submit the current application, fingerprints, certified disposition, prosecutor certification when required, and current fee. A Certificate of Eligibility does not itself seal or expunge the case.
- Use Escambia’s current court packet. The Clerk publishes separate seal and expunge packets. Each uses the existing case number and division and includes a notarized affidavit. The Clerk’s fee schedule lists a $42 charge for sealing a court file or expunging a record.
- File and serve correctly. The Clerk links filers to the Florida Courts E-Filing Portal; confirm the petition and proposed-order route with the assigned division. The Clerk warns that proposed orders filed as ordinary pleadings may enter the correction queue. The current local packets require service on the First Circuit State Attorney and the arresting agency by hand or mail.
The assigned Escambia division controls the next step
The Clerk’s seal and expunge packets do not establish one universal proposed-order or hearing path for every criminal division. The First Judicial Circuit publishes judge-specific procedure pages. After filing, identify the assigned judge and confirm whether that division wants a proposed order, schedules a hearing, or requires another step. No county guide should promise a paper-only decision or remote appearance.
Automatic sealing has limits
Under section 943.0595, the court record becomes confidential after the Clerk’s disposition transmission and FDLE notice when the statutory requirements are satisfied. Other criminal-justice agencies are not required to seal their own copies, and section 943.0595 does not itself govern whether a private background-check vendor updates its files. A useful review therefore asks which record is still visible and which legal or correction process reaches it.
How Dunn Law handles an Escambia record
Dunn Law can retrieve missing certified records, screen the complete incident and history, prepare the FDLE application, coordinate the prosecutor certification when expunction requires it, assemble and file the correct Escambia packet, serve the listed agencies, and follow the assigned division’s current procedure.
Escambia County questions
Can every court document be ordered through E-Certify?
No. Some records are unavailable online, confidential, sealed, or otherwise protected. The Public Records Center is the fallback route for records that cannot be purchased electronically.
Where should Section B be sent?
The First Circuit State Attorney is commonly the correct prosecutor when that office handled the case. As of September 19, 2026, no dedicated Escambia Section B mailing route was located on its public site, so confirm the current submission method before sending it.
Does Escambia require a proposed order?
The county packets do not establish one rule for every judge. Check the assigned division after filing rather than borrowing another division’s instructions.

General information, not legal advice. Eligibility and procedure depend on the complete record, current law, agency instructions, and the assigned court. No result is guaranteed.
