Brevard County Record Sealing and Expungement Lawyer

Brevard County has its own filing packet, service list, and certified-order costs. A person should not begin with the petition forms, however. The first question is whether the disposition and full history fit automatic sealing, court-ordered sealing, court-ordered expunction, or no available relief.

Florida criminal defense attorney Adam Dunn
Adam Dunn handles eligible Florida record-sealing and expungement matters from the firm’s Sarasota office. A Brevard matter is screened count by count before an FDLE application or petition is prepared.

Order the certified Brevard record

The Brevard County Clerk’s Research & Copy Request Center accepts criminal and traffic record requests, including certified copies. The Clerk’s current fee schedule lists $1 per page plus $2 to certify each document. The online docket may help locate the file, but it is not the certified disposition FDLE requests.

Get the disposition for every charge from the incident and any document showing completion of probation, diversion, or another program. An incomplete count history can produce the wrong eligibility answer.

What the Brevard filing actually requires

  1. Check automatic sealing. Section 943.0595 applies only when the matter fits a qualifying no-file or all-count nonconviction outcome and none of the statutory exclusions applies. Automatic sealing does not require other criminal-justice agencies to seal their own copies, and section 943.0595 does not itself govern private background-vendor files.
  2. Complete Section B only for expunction. Brevard’s official instructions identify the Eighteenth Circuit State Attorney’s Sealing and Expungement Section at 2725 Judge Fran Jamieson Way in Viera for the prosecutor certification used in an expunction application. An ordinary sealing application does not use that certification.
  3. Apply to FDLE. Use FDLE’s current application, fee rules, and instructions. Brevard’s Clerk page contains older payment and eligibility language; the current FDLE source controls when the two differ.
  4. File the local packet. After FDLE issues a Certificate of Eligibility, Brevard directs filing of the original petition, notarized affidavit, and certificate with the Clerk. The current local charge is $42.
  5. Serve the petition. Brevard’s Clerk instructions say to send copies to the State Attorney, arresting agency, and Sheriff’s Office. The packet’s certificate of service separately identifies the sheriff of the arrest county if different. The assigned judge decides whether a hearing must be noticed.

Budget for the certified order copies

The Brevard instructions list $1-per-page copying, $2-per-document certification, and a total certified-order copy cost that generally ranges from $12 to $20 depending on the arresting agency and case disposition. Those order copies are part of the local implementation process, but the statutes assign the Clerk the initial distribution of the certified order after relief is granted. A petitioner should not be told that the case is cleared merely because a judge signed an order.

Use current law, not the Clerk’s older eligibility list

The Brevard page is useful for local forms and filing mechanics, but its eligibility and offense list contains legacy wording. Current sections 943.0584, 943.0585, 943.059, and 943.0595—and FDLE’s current instructions—should be used for the legal screening. A withhold of adjudication is not an automatic yes, and a dismissal is not proof that every related record was automatically sealed.

Brevard County questions

Where do I send the expunction certification page?

Brevard’s official instructions identify the Eighteenth Circuit State Attorney’s Sealing and Expungement Section in Viera. Confirm that the office prosecuted the case before sending Section B; statewide prosecutions can use a different authority.

Does FDLE’s certificate clear the case?

No. The certificate is the eligibility determination required before filing the court petition. Relief occurs only after the court grants the petition and the certified order is processed by the agencies.

Will there be a hearing?

The Brevard packets include a notice-of-hearing form, but that does not prove every matter receives a hearing. Follow the assigned judge’s current procedure after filing.
